उपदान संदाय अधिनियम 1972 (Payment of Gratuity Act, 1972)

उपदान संदाय अधिनियम को 10 से अधिक कर्मचारियों की किसी भी संस्था संगठन पर आवश्यक रूप से लागू किया है।

Gratuity : नौकरी पेशा व्यक्तियों को रिटायरमेंट या बीमारी के कारण नौकरी नहीं कर पाने के कारण एक निश्चित धनराशि दी जाती है। यह धनराशि उस नियोजक द्वारा दी जाती है जिस नियोजक के पास में व्यक्ति नौकरी कर रहा था।

अधिनियम की धारा 9 के अंतर्गत कुछ अपराध हैं। उनके दंड भी रखे गए यदि कोई नियोजक इस अधिनियम के अंतर्गत बताए गए उपदान का संदाय करने से बचता है या बचने का प्रयास करता है जब कोई ऐसी विवेचना बनाता है, जिससे वह उपदान का संदाय करने से बच जाए तो यह इस अधिनियम के अंतर्गत अपराध है इसके लिए 6 माह तक का कारावास रखा गया है।

किसी कर्मचारी को उपदान किए जाने के संबंध में कोई नुकसान पहुंचाया जाए तो ऐसी परिस्थिति में 1 वर्ष तक का कारावास रखा गया है। ऐसा कारावास नियोजक यानी संस्था के कर्ताधर्ता को दिया जाएगा।

Time for Gratuity Settlement by Employer - 30 Days


अधिनियम के अंतर्गत उपदान का संदाय करने हेतु नियोजक को 30 दिन का समय दिया गया है। कर्मचारी जिस दिन से उपदान के संदाय हेतु आवेदन जमा करता है उससे 30 दिन की अवधि के भीतर नियोजक को उपदान का संदाय कर देना चाहिए। यदि वह उपदान का संदाय इस समय अवधि के भीतर नहीं करता है। उसके बाद कुछ समय और लेता है तो ऐसी परिस्थिति में नियोजक को कर्मचारी को एक निश्चित दर से ब्याज देना होगा।

यदि कोई कंपनी ग्रेच्युटी देने से मना करे तो क्या करें

स क्षेत्र के भीतर, जहां कंपनी का ऑफिस स्थित है, के पास ग्रेच्युटी भुगतान प्राधिकरण या केंद्रीय श्रम आयुक्त के पास सभी जरूरी कागजात भेजकर शिकायत दर्ज करानी चाहिए। इसके अलावा पीड़ित व्यक्ति न्याय पाने के लिए अपने वकील के माध्यम से पूर्व ऑफिस को नोटिस भेजे और श्रम न्यायालयों (Labour Courts) में मुकदमा दर्ज कराये। जिस दिन कर्मचारी ग्रेच्युटी निकालने के लिए आवेदन करता है उस तारिख से 30 दिन के अन्दर उसे भुगतान मिल जाना चाहिए। यदि कंपनी ऐसा नही करती है तो उसे ग्रेच्युटी राशि पर साधारण ब्याज की दर से ब्याज का भुगतान करना होगा. यदि कंपनी ऐसा नही करती है तो उसे ग्रेच्युटी भुगतान अधिनियम,1972 (Payment of Gratuity Act,1972) के उल्लंघन का दोषी माना जायेगा जिसमे उसे 6 महीने से लेकर 2 साल तक की सजा हो सकती है।

Gratuity की वसूली कैसे  होती  है। 


यदि कर्मचारी द्वारा नियोजक को उपदान के संदाय हेतु आवेदन किया जाता है और नियोजक कर्मचारी को उपदान का संदाय नहीं करता है। ऐसी परिस्थिति में नियोजक की शिकायत यदि नियंत्रक अधिकारी को की जाती है तो वह प्राधिकारी जिले के कलेक्टर को यह प्रमाण पत्र जारी करेगा कि वह भू राजस्व की वसूली की तरह ग्रेज्युटी की रकम को वसूल करें तथा वसूल करके उस रकम को कर्मचारी को प्रदान करे।


सामाजिक सुरक्षा संहिता 2019 (Social Security 2019)  चैप्टर 5 : 

सामाजिक सुरक्षा संहिता में कहा गया है कि कर्मचारी के हर पूर्ण साल की सर्विस पर ग्रैच्युटी 15 दिन की सैलरी पर आधारित होती है. हर पूरे साल या 6 महीने से ज्यादा के समय के लिए कर्मचारी को ग्रेच्युटी 15 दिन की सैलरी की दर पर या केंद्र सरकार के किसी नोटिफिकेशन में तय किए गए दिनों के आधार पर मिलेगी.

ग्रेच्युटी कब मिलती है? : 1. सेवानिवृत्ति होने पर 2. दुर्घटना या बीमारी की वजह से मौत या अपंगता के कारण 3. स्वैच्छिक सेवानिवृत्ति लेने पर 4. छंटनी होने पर 5. इस्तीफ़ा देने पर 6. नौकरी से निकाल दिया जाने पर।

ग्रेच्युटी लेने के लिए कौन सा फॉर्म भरना होता है? : कंपनी को ज्वाइन करते वक़्त कर्मचारी को फॉर्म “F” भर कर उसमे अपने घर के किसी भी सदस्य को नॉमिनी बनाना होता है। यहाँ पर यह बात बताना भी जरूरी है कि यदि कंपनी घाटे में चल रही हो तो भी उसे ग्रेच्युटी राशि का भुगतान करना होगा।

15 X पिछली सैलरी X काम करने की अवधि) भाग 26 यहां पिछली सैलरी का मतलब बेसिक सैलरी, महंगाई भत्ता और बिक्री पर मिलने वाला कमीशन है।

Maximum Amount of Gratuity

2018 में के संशोधन के बाद इस सीमा को बढ़ाकर ₹2000000 कर दिया गया है अब मौजूदा प्रावधानों के मुताबिक ₹2000000 तक ग्रेच्युटी की रकम हो सकती है।

कौन   सी कंपनी Gratuity  देने के लिए  वचनबद्ध होनी चाहिए। 

नियोजक जिनमें कर्मचारियों की संख्या 10 से अधिक है, वह इस अधिनियम के अधीन नियोजक कहलाएंगे।

10 कर्मचारियों से अधिक काम करने वाली संस्थाएं इस अधिनियम के अंतर्गत शासित होगी तथा उन्हें अपने कर्मचारियों को ग्रेच्युटी की धनराशि देना होगी।

कारखाने, खदान, बागान, दुकान और वह सभी सरकारी और गैर सरकारी संस्था जो केंद्रीय राज्य सरकारों तथा लोकल अथॉरिटी आदि। 

ग्रेच्युटी पर कितना कर लगता है? : निजी कर्मचारियों को जब ग्रेच्युटी उनके नौकरी करते समय (रिटायरमेंट के पहले तक) मिलती है, तो उनकी ग्रेच्युटी पर टैक्स लगता है क्योंकि यह उनके वेतन के अंतर्गत आता है लेकिन सरकारी कर्मचारियों को ग्रेच्युटी उनकी सेवानिवृत्ति, मृत्यु या पेंशन के तौर मिलती है और उस पर टैक्स भी नहीं लगता है। श्रम मंत्रालय के नये नियमों के अनुसार संगठित क्षेत्र के कर्मचारी 1 जनवरी 2016 से 20 लाख रुपए तक के कर मुक्त ग्रेच्युटी के लिए पात्र होंगे इससे पहले यह सीमा 10 लाख रुपये थी।

1961 की सेवा नियमावली में ग्रेच्युटी रोकने का कोई उपबन्ध नहीं है. 

आपराधिक मुकदमा चल रहा हो तो रोकी जा सकती है ग्रेच्युटी: HC

विधिविरुद्ध गतिविधियों में लिप्त होने के आरोप में याची को मिलने वाली ग्रेच्युटी इसी आधार पर रोक दी गयी।

अधिकतर केस में या तो Grievance ग्रीवांस Suggestion कह कर या नोटेड कह कर बंद कर दी जाती है या पालिसी मैटर कह कर।
ज्यादातर सरकार से यही जवाब मिलता है की ये तो पॉलिसी लेवल निर्णय है।

पर सत्य इसके बिलकुल विपरीत है टैक्स चोरी और सूनियोजित करप्शन ब्लैक मनी को वाइट करने का। बड़े बड़े नेताओ और पार्टी के स्कूल में पसे लगे हुए।

यहाँ किसी एक स्कूल की बात नहीं हर स्कूल का यही हाल है सरकारी पॉलिसी में ही खोट है जब अपने घर का सिक्का ही कोटा हो तो किसी को क्या कहे।

  • केवल नए स्कूल खुलने के 4 साल तक एनुअल फीस या डेवलपमेंट फीस ली जा सकती है। तो हर साल जनता को क्यो लुटा जा रहा है।
  • Tuition fees के नाम पर 8000 - 9000 /- प्रतिमाह
  • बस फीस के नाम पर 4000 - 4500 /- प्रति माह
  • ड्रेस के नाम पर हर साल - 4000 -5000 /-
  • किताबो जिसमे कही भी MRP नहीं होता स्कूल का लेवल लगा मनचाहे दामों में बीच जाता हे 250 -300 /- each assignment booklet. ( पूरी तरह से टैक्स चोरी )
  • कॉपियों में भी स्कूल का लेवल लगा उलटे सीधे दामों में बेचा जाता है (टैक्स चोरी )

Punjab approves “Educational fee regulator”

To prevent private institutions from charging excessive fee from students, the Punjab government on Monday decided to set up a regulatory body to keep a check on them.

A Punjab government spokesman said that the new regulator was being set up to rationalize and regulate the fee structure in unaided educational institutions across the state.

The decision was taken in the cabinet meeting here chaired by chief minister Parkash Singh Badal.

Issue -3 1 0 /- रूपए के सड़े से ID कार्ड के लिए २०००/- हर साल वसूला जाता है RDFI ID कार्ड के नाम पर 1000 /- ac मेंटेनेंस के नाम पर लिया जाता है केवल नए स्कूल खुलने के 4 साल तक एनुअल फीस या डेवलपमेंट फीस ली जा सकती है। तो हर साल जनता को क्यो लुटा जा रहा है। Tuition fees के नाम पर 8000 - 9000 /- प्रतिमाह बस फीस के नाम पर 4000 - 4500 /- प्रति माह ड्रेस के नाम पर हर साल - 4000 -5000 /- किताबो जिसमे कही भी MRP नहीं होता स्कूल का लेवल लगा मनचाहे दामों में बीच जाता हे 250 -300 /- each assignment booklet. ( पूरी तरह से टैक्स चोरी ) कॉपियों में भी स्कूल का लेवल लगा उलटे सीधे दामों में बेचा जाता है ( टैक्स चोरी )

We have infrastructure, if school run in shift (two or three) or some evening classes just like
UK and USA, So lot of people get opportunity to complete their education.


As per Right to Education act - School should be available for each children. I would like to suggest best suitable solution that School should be run in 3 shifts to increase the opportunity of education for each child.




School Shift for increasing employment and education for every one
First & second shift of 5 hours each + Evening school should be for 3 hours, total 13 hours. Three sets of teachers will be used. This will also help increasing the employment.
Semester System to reduce load on children
Semester System (every 3 month - like in any MBA) need to be introduced for reducing work load and creating better knowledge understanding.
Sports education need to be mandatory
Sports education need to be mandatory and it should have a proper syllabus. This should not be used as free period or PT only. Schools should operate on joint venture system with different sports bodies.


Saving the Girls - Girls Self defense training
Self defense training should be mandatory especially for girls (approximately 100 Hours in a year). This training may start from Class 6th onward



First Aid Education
Adding the First Aid education in schools / colleges will help us save lot of precious lives. In India, awareness on first aid is missing at every level and need to be added different levels.
Mandatory Disaster Management Education

Adding the disaster management education in schools / colleges like sports (few best examples like videos, movie shows (once in week) in schools about disaster management, movie on flood safety, rescue operation, safety in earthquake and safety in fire. One chapter in syllabus on safety and disaster management may be added in school education. Lab room to display best safety features.

For all receipt TIN number or Pan Number should be compulsory. These collages should be treated as small scale industries – type - Education
2. Transparency required in charges fees structure framework is required. National Level common fees regulatory bill required.
3. Grading system of school or colleges ( G1to G4) as per facility standard like basic – drinking water, Spots ground, Toilet, swimming pool, JIM, Zoo, Park, Play Ground, Library, Music facility, drawing art, clay art, etc


4. No donation in elementary education like nursery
5. Development fee only applicable in new school only up to 4 years from registration / establishment of school

Schools are harassing parents for undeclared and inauthentic rules and regulation.There should be some rule and responsibility of school if children not present consecutive 3 days then school should inform parents by email, SMS or call or written letter to ensure no miss happening with children.Before cancelling admission of children at least 2 warning massage should be sending by school.All rules and regulation should be as per national education system and as approved by HRD Ministry.Financial penalty clause on school should be bringing in favor of parents.For everything school should not impose financial penalty.All fee structure definition should be defined nation wise not change school to school.

Patna: With a view to popularising open school education via visual media, the National Institute of Open Schooling (NIOS) will run three direct-to-home (DTH) television channels under the HRD ministry's 'Swayam Prabha', which is likely to be launched by PM Narendra Modi on August 15.

The NCERT will run a channel on Class IX and X school education while the CBSE will run four channels: physics, chemistry, mathematics and biology - all for Class XI and XII students and IGNOU will also run four channels on different subjects.

And there are so many new private universities in India and we’d like to work with them. But we also respect the older universities because they have a higher status, but often not much money.

Moving forward, what are the challenges in education?
Huge financial challenges in making education affordable for many more students. We’ve got to find very clever ways of using new technology in the best way to improve the quality of education, while we reduce the costs. I also believe women’s education is important everywhere. If we don’t drive that we’re not going to get social change.

🤪 हमारे माताजी पिताजी को हमारी पढ़ाई का बोझ है..ऐसा कभी  लगा ही नहीं....

लगता है देश बेचने का काम हो रहा है।

राष्ट्रीय शिक्षा नीति में शिक्षा पर जीडीपी का 6% खर्च करने की बात कही गई है।

      स्कूल   चैरिटेबल ट्रस्ट  बना गरीब बच्चो के सपोर्ट के नाम पर सस्ते दामों में जमीने  लेते है  और education  लॉबी सरकारी विभाग हमेशा  स्कूल के फेवर में निर्णय लेते है ,सरकारी अधिकारियो,एजेंट और स्कूल ऑपरेटर्स की मदद से पैसे  की हेरा फेरी की जाती है,
      टैक्स चोरी के लिए स्कूल , GST चोरी के लिए स्कूल ,
       
      स्कूल ऑपरेटर्स भी किसी हाई कोर्ट का आर्डर दिखा हर साल 9-15% फीस बढ़ा  देते है। 
      इस चोरी में पूरी लॉबी  इन्वॉल्व है , सरकारी विभाग से लेकर स्कूल ऑपरेटर्स तक , सर्कार के दबाव में कोई incometax , GST  ऑडिट नहीं होती , स्कूलों पर कोई पेनल्टी और एक्शन नहीं होता और केवल जनता , माँ बाप  का education  के नाम पर मौलिक अधिकारों का शोषण होता है। 

      Example of tax chori जहाँ  गवर्नमेंट अधिकारी  और विभाग आखे बंद कर लेते है। 

      1 . Bus  सर्विस  स्कूल मनचाही  रकम वसूलते है , आउटसोर्स ऑपरेटर्स के नाम पर 
      2  किताबे  - बगैर MRP की किताबे  स्कूल प्रिंसिपल्स ने अपनी जिंदगी में एक किताब नहीं लिखी होगी  पर स्कूल प्रिंसिपल का नाम छाप  कर जबरदस्ती मनचाही  रकम वसूलते है , आउटसोर्स ऑपरेटर्स के नाम पर 
      3 . स्कुल  कोचिंगइंस्टिट्यूट के साथ  मिली भगत करके  स्कुल परिसर में ही अलग कमिशन का बिज़नेस कर रहे है ,  
       
      DPS -SAP -The School Accelerated Program-
      Amity Synchrostudy - दिल्ली डोमेकिले के नाम पर पैसा वसूली 
      RPS - The Richmond Public Schools- Gifted & Talented Programs के नाम पर पैसा वसूली , many more
    • Tax chori karane ke liye consolidated fees ki raceipt di jati he. koi detail vivaran nahi taki CA manupulation kar sake.
    • 1000 /- ac मेंटेनेंस के नाम पर लिया जाता है, Has school paid GST to government of India on money Collected in the name of any additional service charges (which is unethically) ( like AC Maintenance, book commission collected and sell by shell company /out side vendor but school brand posted to rise book cost 500 to 1000 times.
    • केवल नए स्कूल खुलने के 4 साल तक एनुअल फीस या डेवलपमेंट फीस ली जा सकती है। तो हर साल जनता को क्यो लुटा जा रहा है।
    • Tuition fees के नाम पर 8000 - 9000 /- प्रतिमाह
    •  3rd party vendors paying 20-30% commission to school in the name of books, bus fees, dress which is creating black money for school
    •  बस फीस के नाम पर 4000 - 4500 /- प्रति माह GST credit input has taken from vendor but not issue GST breakup receipt to parents for bus fees.
    • ड्रेस के नाम पर हर साल - 4000 -5000 /- (Shell companies used to divert funds and tax chori) – Vendor channel
    • Assignment booklets किताबो जिसमे कही भी MRP नहीं होता स्कूल का लेवल लगा मनचाहे दामों में बीच जाता हे 250 -300 /- each assignment booklet. (पूरी तरह से टैक्स चोरी)
    • कॉपियों में भी स्कूल का लेवल लगा उलटे सीधे दामों में बेचा जाता है (टैक्स चोरी)  
    • कैंटीन में जंक फ़ूड कोस्टा ,कोल्ड कॉफी, पिज़ा,बरिस्ता,... केनाम पर शोषा कर३र्ड पार्टी वेंडर के नाम पर टैक्स चोरी।
