51. वरिष्ठ नागरिक सुरक्षा – कानून एवं आंतरिक सुरक्षा



भारत विज़न 2047 – 100 राष्ट्रीय नीति सुधार (Policy Reforms)

“सुरक्षित वरिष्ठ नागरिक = सुरक्षित परिवार = सुरक्षित समाज = मजबूत भारत”

भारत में जनसांख्यिकीय परिवर्तन अब केवल सामाजिक कल्याण का विषय नहीं है—यह कानून-व्यवस्था, आंतरिक सुरक्षा, स्वास्थ्य, डिजिटल सुरक्षा, वित्तीय सुरक्षा, रोजगार और आर्थिक विकास से सीधे जुड़ा राष्ट्रीय नीति-विषय बन चुका है।

UNFPA के अनुसार भारत में 60 वर्ष और उससे अधिक आयु के लोगों की संख्या 2022 में लगभग 153 मिलियन थी और 2050 तक यह लगभग 347 मिलियन हो सकती है। 2050 तक वरिष्ठ नागरिकों की आबादी कुल आबादी की लगभग 20% तक पहुँचने का अनुमान है।

इसलिए Vision 2047 के लिए लक्ष्य केवल “वरिष्ठ नागरिकों की देखभाल” नहीं होना चाहिए, बल्कि Senior Citizen Safety Infrastructure का निर्माण होना चाहिए—जिसमें पुलिस, न्याय, स्वास्थ्य, बैंकिंग, साइबर सुरक्षा, आवास, परिवहन और डिजिटल सेवाएँ एकीकृत हों।


1. वर्तमान स्थिति

भारत में वरिष्ठ नागरिकों की सुरक्षा के लिए कई महत्वपूर्ण संस्थागत व्यवस्थाएँ पहले से मौजूद हैं।

प्रमुख सरकारी पहल

Maintenance and Welfare of Parents and Senior Citizens Act, 2007

इस कानून में maintenance, welfare, medical support, old-age homes तथा senior citizens के जीवन और संपत्ति की सुरक्षा से संबंधित प्रावधान हैं। इसमें Maintenance Tribunal, Appellate Tribunal तथा abandoned senior citizens से संबंधित प्रावधान भी शामिल हैं।

Elderline – 14567

भारत सरकार की National Helpline for Senior Citizens – Elderline 14567 एक महत्वपूर्ण पहल है। यह सूचना, guidance, emotional support और abuse के मामलों में field intervention उपलब्ध कराती है। वर्तमान व्यवस्था के अनुसार यह सप्ताह के सातों दिन सुबह 8 बजे से रात 8 बजे तक संचालित होती है।

2026 में सरकार द्वारा Elderline और “Ageing with Dignity” अभियान को वरिष्ठ नागरिकों की गरिमा, सुरक्षा और inclusion से जोड़ा गया है। जुलाई 2026 तक इस अभियान के तहत 5.36 लाख से अधिक नागरिकों ने National Pledge लिया था।

स्वास्थ्य सुरक्षा

National Programme for Health Care of the Elderly के तहत district hospitals, CHCs और PHCs में geriatric services, physiotherapy तथा geriatric wards जैसी सुविधाओं को बढ़ावा दिया जा रहा है।

प्रमुख चुनौती

व्यवस्थाएँ मौजूद हैं, लेकिन समस्या integration और last-mile enforcement की है।

एक वरिष्ठ नागरिक को आज भी अलग-अलग समस्याओं के लिए अलग-अलग व्यवस्था से संपर्क करना पड़ सकता है:

Police → Hospital → Bank → Cyber Cell → Legal Aid → Pension Office → Tribunal → Local Administration

Vision 2047 का लक्ष्य होना चाहिए:

“One Senior Citizen – One Integrated Safety Network.”

वरिष्ठ नागरिकों के साथ:

Japan ने ageing society के लिए community-based care, long-term care और स्थानीय स्तर पर integrated support systems विकसित किए हैं।

Singapore

Singapore में ageing को healthcare, housing, active ageing और community participation से जोड़ा गया है।

OECD देशों

OECD देशों में dementia policy, early diagnosis, prevention, caregiver support और coordinated care pathways पर बढ़ता जोर दिखाई देता है। 2026 के OECD analysis में 29 OECD देशों की dementia policies की समीक्षा की गई है।

भारत के लिए सीख

भारत को विदेशी मॉडल की नकल करने के बजाय:

incidents of crime against women and children in different parts of the country, it has
become imperative that fast actions and sustainable steps be taken to minimize incidents
against our Women and Children.

I have witnessed some cases where the police are too rude with women when they approach them for justice at their level and the women in distress are driven out and sometimes they are branded badly instead of the culprit, because they don't want to take any complaints and probe into the crime, but wash their hands off. It is easier to drive away a lady than a man unless the media exposes their actions. If the police take strict action against the offenders then the rate of crime against women and girl children will come down drastically. But that is not the case in many instances, bribe plays a key role in many criminal activities and once offender bribes the police he is let free and he becomes like a man eater which tastes the flesh of the humans and starts attacking more and more humans for food, as he also now knows that by bribing the police he can go scot free and he can continue with more and more such serious offences without getting into legal tangles – Veidehi Chillakumari 
  16. The biggest cause of girls not being wanted in society is the prevailing dowry system in arranging marriages. Things have gone completely out of hand in the villages especially since the girls family has to bear the cost of the marriage as well as the dowry provided. वर्तमान स्थिति

भारत विश्व की सबसे तेजी से वृद्ध होती आबादी वाले देशों में शामिल है। 2023-24 के अनुमान के अनुसार भारत में 60 वर्ष से अधिक आयु के लगभग 15 करोड़ से अधिक नागरिक हैं, जो 2047 तक 30 करोड़ से अधिक हो सकते हैं।

वर्तमान में केंद्र सरकार की Indira Gandhi National Old Age Pension Scheme (IGNOAPS) के अंतर्गत मिलने वाली केंद्रीय सहायता कई राज्यों में अभी भी बहुत कम (₹200–₹500 प्रति माह) है। कुछ राज्य अपनी ओर से अतिरिक्त राशि देते हैं, लेकिन पूरे देश में कोई समान न्यूनतम सामाजिक सुरक्षा उपलब्ध नहीं है।

Maintenance and Welfare of Parents and Senior Citizens Act, 2007 वरिष्ठ नागरिकों के अधिकारों की रक्षा करता है, लेकिन अधिकांश बुजुर्गों की आय सुरक्षा अभी भी सीमित है।

2016-17 के आर्थिक सर्वे में मोदी सरकार ने यूबीआई का जिक्र किया। तब आर्थिक सर्वेक्षण में यूनिवर्सल बेसिक इनकम पर 40 से अधिक पेजों का एक खाका तैयार किया गया था। इस रिपोर्ट के अनुसार, यूनिवर्सल बेसिक इनकम भारत में व्याप्त गरीबी का एक संभव समाधान हो सकता है।


लंदन यूनिवर्सिटी के प्रफेसर गाय स्टैंडिंग ने गरीबी हटाने के लिए अमीर-गरीब, सबको निश्चित अंतराल पर तयशुदा रकम देने का विचार पेश किया।

इस स्कीम का लाभ लेने के लिए किसी भी व्यक्ति को अपनी कमजोर सामाजिक-आर्थिक स्थिति अथवा बेरोजगारी का सबूत नहीं देना पड़े। 


यूबीआई के दायरे में देश की पूरी आबादी को नहीं लाया जा सकता है, इसलिए इसके वास्तविक लाभार्थियों की पहचान करना सबसे बड़ी चुनौती है।

Universal Basic Income में use  की जाने वाली संभावनाए:

पहला- आर्थिक दृष्टि से निचले पायदान की 75 प्रतिशत आबादी को यूबीआई के दायरे में लाया जाए। 

दूसरा- सिर्फ महिलाओं को इसके दायरे में लाया जाए क्योंकि महिलाओं को रोजगार के अवसर, शिक्षा, स्वास्थ्य एवं वित्तीय समावेशन के मोर्चों पर हमेशा पिछड़ेपन का सामना करना पड़ता है। इससे आबादी का आधा हिस्सा यूबीआई के दायरे में आएगा। सर्वे में कहा गया था कि महिलाओं के हाथ में पैसे गए तो उनके दुरुपयोग की आशंका भी नहीं के बराबर रहेगी। 

तीसरा- शुरुआत में यूबीआई स्कीम का लाभ विधवाओं, गर्भवती महिलाओं के साथ-साथ वृद्ध एवं बीमार आबादी को दिया जा सकता है।

As we know about India is country of culture, supporting family culture and joint family culture, respective senior citizen But due to recent western trend these value missing to re-establish the link government should have to come with a new solution
Government Role and responsibility in saving elders

Government of India  and  Income Tax department must have to take initiatives to save the seniors by providing  tax benefit to children includes children and grandchildren, step-children, adoptive children, children-in-law for  paying  monthly minimum 10000/-  to  mother, father, uncle or any senior blood relation of father or any  senior citizen above 60 years + biological, adoptive, and step-parents but parent-in-laws and grandparents.

This will bring lots of family culture and help senior citizen to pay for  their medical ,food related need.  Maximum Tax free amount should be 3 lakhs per years against Pan Number of parents.

The Maintenance & Welfare of Parents & Senior Citizens (Amendment) Bill 

Senior citizens, parents can get over Rs 10,000 for maintenance 


The Maintenance & Welfare of Parents & Senior Citizens (Amendment) Bill, 2019 is on the agenda of the Union Government. It is also in the list of bills likely to be taken up during monsoon session 2021 shared by the Ministry of Parliamentary Affairs. 


Bill will give more power to senior citizens and parents

This Bill for the maintenance of senior citizens and parents was first approved by the Union Cabinet in December 2019 but is yet to be cleared by the Parliament 

  1. The definition of maintenance has also been expanded in the amendment bill to include the provision of healthcare, safety, and security for parents to lead a life of dignity. The earlier definition of maintenance under the Act included the provision of food, clothing, residence, medical attendance, and treatment only. One of the most important changes that the amendment bill seeks to introduce is the removal of the cap of Rs 10,000 as maintenance charge. If the bill becomes a law then more than Rs 10,000 can be awarded as a maintenance amount. While announcing such an award, the maintenance tribunals will have to consider the standard of living and earning of the parent or senior citizen as well the earnings of the children before deciding the maintenance amount. 
  2. The number of days in which children and relatives must pay the maintenance amount will also be reduced from 30 days to 15 days. 
  3. The Maintenance & Welfare of Parents & Senior Citizens (Amendment) Bill, 2019 introduces several changes to The Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The amendment bill widens the definition of children. Under the Act, the definition of children includes children and grandchildren, excluding minors. However, the Amendment Bill has added step-children, adoptive children, children-in-law, and the legal guardian of minor children to the definition. 
  4. The definition of parents in the amendment bill not just includes biological, adoptive, and step-parents but parent-in-laws and grandparents also.


Few Key Observation and opinion

  • If government and Income Tax department will start giving tax benefit to pay monthly minimum 20000/- to mother, father, uncle or any senior blood relation of father or any senior citizen above 60 years + this will bring lots of family culture and help senior citizen to pay for their medical ,food related need. Maximum Tax free amount should be 5 lakhs per years
  • Special reservation for senior citizen in railway means at least lower birth confirmation if person is senior citizen.
  • Surety of reservation if senior citizen travelling in railway.
  • Current system in railway ticket reservation is not perfect intelligent. Most of the time if we choose lower birth ticket required ticket was not booked and money goes in fail transaction. Or if we choose none to at least book the ticket it gives middle or upper birth in railways train. So lower seat reservation quota should be introduce by railway government for senior citizen , handicap person, pregnant women, and girls like in our metro train. Proper reservation marking should be defined in our new train system.
  • Need of transparency in rail ticket booking system – available seat should be shown by graphically in railway also ( two great example for the same: air line online checking and boarding pass system, and 2nd one as we book any movie ticket by book my show site it shows available seat and allow us to choose the seat available.
  • Their should be fix marked lower seats in Railway for senior citizen and pregnant women, Girls with Small child
  • Lack of transparency in Railway Booking system

2. Railways makes due provisions for senior citizens, women
computerized Passenger Reservation System (PRS) there is a provision to allot lower berths automatically to senior citizens and to female passengers 45 years and above, even if it is not opted for, subject to availability of' accommodation at the lime of booking.

Reply by IRCTC / Railway Officer on Senior citizen Issue: Sweet English Answer but not real level solution

 Issue : All Senior Citizen got Upper and middle seat in booking – it is drawback or incapability of railway software or  insensitivity of Railway /IRCTC . There should be some penalty clause for railway also

Really bad manipulation by Railway- misguided to general public and Over ruled the PMO  & Ministry of Social Justice and Empowerment Request - Save the Senior

Dear Customer,
Please note that your reservation request is processed by the centralized Passenger Reservation System (PRS) of Railways and allotment of accommodation is done by the System without any manual intervention. The berths are allotted based on the system logic, depending on availability at that point of time. Further the reservation through the Internet is being done against the general quota and specific accommodation is not earmarked for the purpose of Internet reservations. (really bad manipulation by Railway)

Please note that at the time of journey you can request the fellow-passengers for change of the seats. It is not possible to change the berth after booking.

Kindly note that according to Railway Rules SS Quota will be applied (really bad manipulation by Railway) if there is only one Senior Citizen (of the age 45 and above for females and 60 and above for males) in one transaction and seats will be allotted according to it. SS Quota will not be considered for the transaction in which there are more than one Senior Citizen.
