1. What Happened?

भारत में internet और digital platforms का विस्तार बहुत तेजी से हुआ है। इसके साथ digital identity, misinformation, impersonation, fake accounts और misleading commercial information से जुड़े risks भी बढ़े हैं।

भारत सरकार ने 2021 में Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules लागू किए। Significant Social Media Intermediaries के लिए voluntary user verification, visible verification mark, grievance mechanisms और अन्य due-diligence requirements निर्धारित की गईं।

2026 में सरकार ने synthetically generated information, including AI-generated content और deepfakes से जुड़े risks को address करने के लिए IT Rules framework को और मजबूत किया।

अर्थात भारत की policy journey अब:

Digital Access → Digital Governance → Digital Safety → Digital Trust

की ओर बढ़ रही है।


2. Why Does It Matter?

आज किसी व्यक्ति का पहला interaction कई बार physical office में नहीं, बल्कि digital platform पर होता है।

एक consumer:

Google/Search → Social Media → Property Portal → Marketplace → Payment

या

Matrimonial Profile → Chat → Video Call → Financial Transaction

जैसी पूरी digital journey से गुजर सकता है।

यदि शुरुआती information गलत है, तो पूरी transaction chain प्रभावित हो सकती है।

इसलिए 2047 तक भारत के लिए केवल Digital India पर्याप्त नहीं होगा।

4. वर्तमान स्थिति

भारत में पहले से कई महत्वपूर्ण regulatory foundations मौजूद हैं।

Social Media

IT Rules, 2021 के तहत 50 लाख या उससे अधिक registered users वाले Significant Social Media Intermediaries के लिए अतिरिक्त obligations हैं। Users को voluntary verification facility और visible verification mark उपलब्ध कराने का प्रावधान है।

यह distinction महत्वपूर्ण है:

वर्तमान व्यवस्था universal mandatory public identity disclosure नहीं है।

Real Estate

RERA framework में misleading representation और ऐसे services के advertisement पर restrictions हैं जिन्हें वास्तव में offer करने का intention नहीं है। Promoters को project-related information public domain में उपलब्ध कराने की भी व्यवस्था है।

Data Protection

भारत ने Digital Personal Data Protection Act, 2023 के बाद Digital Personal Data Protection Rules, 2025 भी notify किए हैं। MeitY के अनुसार Rules को 14 November 2025 को notify किया गया और phased implementation framework दिया गया।

इससे policy का एक महत्वपूर्ण principle सामने आता है:

Verification और Privacy को साथ-साथ आगे बढ़ाना होगा।

5.1 IT Rules, 2021

सरकार का घोषित objective है:

IT Rules में misinformation, impersonation और unlawful content से संबंधित intermediary due diligence requirements हैं।

5.2 Voluntary Social-Media Verification

Significant Social Media Intermediaries को users के लिए voluntary verification mechanism उपलब्ध कराना है।

5.3 Grievance Redressal

Platforms पर grievance mechanisms स्थापित करने की व्यवस्था है।

2026 के amended framework में कुछ categories के unlawful content और grievances के लिए timelines को और मजबूत किया गया है।

5.4 AI / Deepfake Regulation

2026 में synthetically generated information और AI-generated/deepfake content से जुड़े risks के लिए additional compliance और labelling/traceability measures शामिल किए गए।

5.5 Data Protection

DPDP Rules, 2025 भारत में personal-data governance को operational framework प्रदान करते हैं।


6. विश्वसनीय आँकड़े क्या कहते हैं?

World Bank के latest country data के अनुसार 2025 में भारत का:

  • GDP: लगभग US$3.96 trillion
  • GDP growth: 7.6%
  • GDP per capita: लगभग US$2,702.5

था।

IMF के April 2026 World Economic Outlook के अनुसार भारत की growth 2026 और 2027 के लिए 6.5% projected थी।

इस economic scale पर digital trust में छोटे efficiency improvements भी बड़े absolute economic effects पैदा कर सकते हैं।

लेकिन यह कहना उचित नहीं होगा कि verification reform अपने आप GDP में किसी निश्चित प्रतिशत की वृद्धि करेगा।

इसलिए इस article में GDP estimates को policy scenarios के रूप में देखा जाना चाहिए, official forecast के रूप में नहीं।


7. FDI की पृष्ठभूमि

UNCTAD के World Investment Report 2026 के अनुसार global FDI 2025 में 6% बढ़कर लगभग US$1.6 trillion हुआ, लेकिन developing economies में वृद्धि केवल लगभग 2% रही और investment increasingly strategic sectors तथा AI-related digital infrastructure की ओर केंद्रित रही।

भारत के DPIIT के अनुसार April 2000 से September 2025 तक cumulative FDI inflow लगभग US$766.9 billion था।

इसलिए भारत के लिए अगला सवाल केवल:

“FDI कितना आए?”

नहीं, बल्कि:

“FDI से technology, productivity, jobs और trusted digital infrastructure कितना बने?”

होना चाहिए।

किसी अन्य व्यक्ति के नाम पर account।

Property/business उपलब्ध न होने के बावजूद advertisement।

भारत में इस दिशा में पहले से कई कानूनी व्यवस्थाएँ मौजूद हैं। IT Rules, 2021 में Significant Social Media Intermediaries के लिए voluntary user verification का प्रावधान है। RERA में registered real-estate agents, misleading representations और advertisements से संबंधित दायित्व हैं। वहीं Digital Personal Data Protection Act, 2023 व्यक्तिगत डेटा के lawful processing और privacy को महत्व देता है।

इसलिए भविष्य का सुधार “हर जगह Aadhaar अनिवार्य” करने के बजाय “risk-based, purpose-limited और privacy-preserving verification” पर आधारित होना चाहिए।


1. समस्या क्या है?

डिजिटल प्लेटफॉर्म पर मुख्य समस्याएँ हैं:

  • Fake social-media accounts
  • दूसरे व्यक्ति के नाम से impersonation
  • Fake real-estate listings
  • ऐसी property का advertisement जो वास्तव में उपलब्ध नहीं है
  • पुराने/inactive advertisements
  • Fake matrimonial profiles
  • Broker/agent की अस्पष्ट पहचान
  • ग्राहक की personal information का अनावश्यक संग्रह
  • Advertisement देखकर call करने वाले नागरिकों को misleading information मिलना
  • Verified और unverified information में अंतर स्पष्ट न होना
  • शिकायत के बाद जिम्मेदार व्यक्ति/व्यवसाय तक पहुँचना कठिन होना

विशेष रूप से real-estate sector में किसी listing की वास्तविक स्थिति—Available, Booked, Sold, Under Negotiation या Expired—स्पष्ट नहीं होने पर consumer का समय और पैसा दोनों प्रभावित हो सकते हैं।


2. वर्तमान स्थिति क्या है?

भारत में accountability की दिशा में पहले से महत्वपूर्ण regulatory framework मौजूद है।

Social Media

IT Rules, 2021 के तहत 50 लाख या उससे अधिक registered users वाले Significant Social Media Intermediaries के लिए अतिरिक्त due-diligence obligations हैं। इनमें users को voluntarily verify करने की सुविधा और verified accounts को visible verification mark देने का प्रावधान शामिल है।

इसका अर्थ महत्वपूर्ण है:

भारत में वर्तमान व्यवस्था blanket mandatory identity verification नहीं है।

यह distinction privacy और freedom of expression दोनों के लिए महत्वपूर्ण है।

साथ ही, impersonation और cheating के लिए IT Act की Section 66D जैसी कानूनी व्यवस्थाएँ भी मौजूद हैं।

Real Estate

RERA, 2016 के अंतर्गत registered real-estate agents को registration number दिया जाता है और उन्हें sale transactions में उसका उपयोग करना होता है। कानून registered agents को unfair trade practices और false या misleading representations से भी रोकता है।

RERA की Section 12 advertisement/prospectus में incorrect या false statement से consumer को हुए नुकसान के लिए promoter की liability का प्रावधान करती है।

इसलिए real-estate portals के लिए भी एक महत्वपूर्ण principle पहले से मौजूद है:

Advertisement केवल marketing material नहीं, consumer-information का हिस्सा है।


3. विश्वसनीय आँकड़े क्या कहते हैं?

भारत में digital-platform regulation कोई छोटी समस्या नहीं है।

2021 में सरकार द्वारा प्रकाशित जानकारी के अनुसार प्रमुख platforms के भारत में करोड़ों registered/users थे; उदाहरण के लिए WhatsApp के लिए लगभग 53 करोड़, YouTube के लिए 44.8 करोड़ और Facebook के लिए 41 करोड़ users के आँकड़े दिए गए थे।

इसीलिए IT Rules में 50 लाख registered users का threshold Significant Social Media Intermediaries की अतिरिक्त जिम्मेदारियों के लिए निर्धारित किया गया था।

2025–26 में regulatory framework में AI-generated/synthetically generated information और deepfakes से जुड़े risks को भी अधिक महत्व दिया गया है।


4. भारत की मुख्य चुनौती क्या है?

भारत के सामने चुनौती केवल identity verification नहीं है।

मुख्य चुनौती है:

Identity + Authenticity + Accountability + Privacy

उदाहरण के लिए:

व्यक्ति कौन है?

क्या वह वास्तव में वही व्यक्ति है?

यदि verification के नाम पर सभी platforms को Aadhaar/PAN की copy रखने की अनुमति दे दी जाए, तो एक नई privacy risk भी पैदा हो सकती है।

इसलिए policy का लक्ष्य होना चाहिए:

“Verify the person, not expose the person.”


5. Global Benchmark क्या है?

अलग-अलग देशों में digital identity के लिए अलग approaches अपनाए गए हैं।

एक common policy principle यह है कि:

Authentication और underlying personal data storage अलग-अलग चीजें हो सकती हैं।

भारत के लिए भी ऐसा model विकसित किया जा सकता है जिसमें platform को केवल इतना confirmation मिले:

“Identity verified — Yes/No”

लेकिन platform के database में नागरिक का पूरा Aadhaar number या biometric information stored न हो।

इसे कहा जा सकता है:

6. Proposed Reform — Digital Trust Verification Framework

भारत में एक integrated framework प्रस्तावित किया जा सकता है:

DTVF — Digital Trust & Verification Framework

इसके अंतर्गत platforms को तीन स्तरों में बाँटा जा सकता है।

Level 1 — Basic Verification

सामान्य low-risk accounts:

  • Mobile/email verification
  • Bot detection
  • CAPTCHA
  • suspicious activity monitoring

Level 2 — Professional Verification

Business/professional accounts:

  • PAN/GSTIN/company registration
  • professional registration
  • business address
  • authorised representative verification

Level 3 — High-Risk Commercial Verification

Real estate, financial services, high-value marketplace sellers आदि:

  • verified legal identity
  • PAN/GST/business registration
  • relevant regulatory registration
  • verified contact details
  • platform-level audit trail

7. Social Media के लिए Proposed Reform

वर्तमान IT Rules में voluntary verification पहले से मौजूद है।

अगला कदम यह हो सकता है कि platform पर verification के अलग-अलग labels हों:

Identity Verified

व्यक्ति की identity platform या trusted verification provider द्वारा verify की गई।

Business Verified

Business existence और registration verified।

Government/Institution Verified

संबंधित institution की official identity verified।

Unverified

Account की identity independently verified नहीं है।

इससे user को बेहतर information मिलेगी, लेकिन हर anonymous user को अनिवार्य रूप से public identity disclose करने की आवश्यकता नहीं होगी।


8. Real Estate Platforms के लिए Proposed Reform

Real-estate portals के लिए यह reform विशेष रूप से महत्वपूर्ण हो सकता है।

प्रत्येक listing में mandatory fields

  • Project/RERA registration number, जहाँ लागू हो
  • Owner/Promoter/Agent category
  • Agent RERA registration number, जहाँ लागू हो
  • Listing creation date
  • Last verified date

  • Carpet/built-up area, जहाँ relevant हो

9. Advertisement Life Cycle Reform

आपके प्रस्ताव का एक महत्वपूर्ण हिस्सा है:

“Advertisement Expiry System”

प्रत्येक advertisement की validity fixed period की हो।

उदाहरण:

10. “Lead Generation Trap” को कैसे रोका जाए?

किसी property को जानबूझकर कम कीमत पर दिखाकर customer से contact information लेना और बाद में कहना कि property उपलब्ध नहीं है—यदि ऐसा व्यवहार misleading representation या unfair trade practice की श्रेणी में आता है, तो existing legal remedies और platform-level enforcement महत्वपूर्ण हो सकते हैं।

इसलिए portal को केवल listing host नहीं बल्कि information-quality gatekeeper की भूमिका निभाने के लिए minimum verification standards रखने चाहिए।


11. PAN और Aadhaar — क्या दोनों अनिवार्य होने चाहिए?

यहाँ सावधानी आवश्यक है।

PAN

PAN को business/professional verification में उपयोग करने का policy case कुछ categories में हो सकता है, लेकिन platform को केवल आवश्यक information ही रखनी चाहिए।

Aadhaar

Aadhaar को हर platform पर mandatory database field बनाना privacy risk पैदा कर सकता है।

Supreme Court के Aadhaar judgment ने private entities द्वारा Aadhaar use से संबंधित Section 57 के व्यापक framework पर महत्वपूर्ण संवैधानिक सीमाएँ लगाईं।

इसलिए बेहतर model हो सकता है:

Aadhaar Number Storage — No

Trusted Identity Authentication — Yes

अर्थात platform को verification का result मिले, Aadhaar number की copy नहीं।


12. Matrimonial Websites के लिए Reform

Matrimonial platforms में fake profiles का सामाजिक और आर्थिक impact गंभीर हो सकता है।

Proposed verification:

  • Mobile verified
  • Email verified
  • Identity verified
  • Age verified
  • Education claim verified — optional
  • Employment claim verified — optional
  • Income claim verified — optional
  • Photograph freshness check
  • Report/complaint mechanism

लेकिन sensitive information जैसे caste, religion, health, income आदि का collection purpose-specific और privacy-protective होना चाहिए।


13. Personal Information Privacy

Digital verification का अर्थ यह नहीं होना चाहिए कि platform नागरिक की सारी जानकारी अपने पास जमा कर ले।

Digital Personal Data Protection Act, 2023 का framework personal data processing में individual privacy और lawful processing के बीच संतुलन पर आधारित है। Consent-based processing के लिए consent का free, specific, informed, unconditional और unambiguous होना आवश्यक बताया गया है।

इसलिए proposed system के मूल principles होने चाहिए:

Data Minimisation

जितना आवश्यक हो, उतना ही data।

Purpose Limitation

एक उद्देश्य के लिए लिया data दूसरे unrelated उद्देश्य में इस्तेमाल न हो।

Encryption

Sensitive verification information को strong encryption से सुरक्षित किया जाए।

Limited Retention

Verification complete होने के बाद unnecessary documents हटाए जाएँ।

Audit Trail

किसने verification किया, कब किया और किस purpose के लिए किया—इसका secure record रहे।

Citizen Control

जहाँ consent basis लागू हो, वहाँ नागरिक को applicable privacy rights मिलें।


14. Implementation कैसे होगा?

Implementation को पाँच चरणों में किया जा सकता है।

Phase 1 — Standardisation

Central Government:

तैयार करे।

पहले:

27. “Fake Listing → Fake Lead” Model को रोकना

यदि कोई property उपलब्ध नहीं है, तो उसका advertisement indefinitely live नहीं रहना चाहिए।

Proposed rule:

No confirmation → Automatic deactivation

यदि agent/property owner फिर से availability confirm करता है:

Reverification → Reactivation

इस simple mechanism से outdated listings की संख्या कम की जा सकती है।


28. Government Initiative और Future Reform में अंतर

भारत सरकार पहले से social-media accountability के लिए IT Rules लागू कर चुकी है। Significant Social Media Intermediaries के लिए voluntary verification, grievance mechanisms, compliance officers और reporting requirements जैसी व्यवस्थाएँ मौजूद हैं।

2026 में IT Rules framework को AI-generated/synthetically generated information से जुड़े risks के संदर्भ में भी मजबूत किया गया है।

इसलिए proposed reform को existing laws को replace करने के बजाय:

Existing Framework + Digital Identity + Platform Accountability + Privacy-by-Design

के रूप में विकसित किया जा सकता है।


29. नागरिक अधिकारों का संतुलन

यह reform केवल “हर व्यक्ति की पहचान जानना” नहीं होना चाहिए।

एक लोकतांत्रिक digital society में चार principles का संतुलन आवश्यक है:

Freedom

वैध expression और participation की स्वतंत्रता।

Privacy

व्यक्तिगत information की सुरक्षा।

Accountability

गलत या आपराधिक व्यवहार के लिए जिम्मेदारी।

Consumer Protection

गलत commercial information से नागरिक की रक्षा।

इन चारों में संतुलन बनाना ही Trusted Internet का वास्तविक उद्देश्य होना चाहिए।


30. निष्कर्ष

भारत तेजी से एक digital economy बन रहा है। अगला चरण केवल Digital India नहीं, बल्कि Trusted Digital India होना चाहिए।

Social media पर fake accounts, real-estate portals पर outdated listings, matrimonial platforms पर fake profiles और online marketplaces पर misleading information जैसी समस्याओं का समाधान केवल अधिक data collection से नहीं होगा।

समाधान होना चाहिए:

“Minimum Data — Maximum Accountability”

और:

“Verify Without Exposing.”

भारत एक ऐसा Digital Trust Framework विकसित कर सकता है जिसमें genuine users और businesses को credibility मिले, fraudulent actors की traceability बढ़े, consumers को reliable information मिले और साथ ही नागरिकों की privacy सुरक्षित रहे।

Vision 2047

एक ऐसा भारत जहाँ डिजिटल पहचान विश्वास पैदा करे,
डिजिटल प्लेटफॉर्म जवाबदेह हों,
नागरिकों का डेटा सुरक्षित हो,
और technology नागरिक की स्वतंत्रता तथा सुरक्षा—दोनों को मजबूत करे।


Key Policy Recommendation

Mandatory public identity disclosure नहीं; बल्कि risk-based verification, privacy-preserving authentication, advertisement lifecycle management, platform accountability और independent audit को एकीकृत किया जाए।

यही approach Safe Internet + Trusted Marketplace + Privacy-First Digital India की दिशा में एक व्यावहारिक कदम हो सकती है।

Mandatory Verification of Social Media Accounts

 

Usually, anonymous use of platforms is seen as protecting privacy of users. However, to ensure accountability, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules”) cast prescribed obligations on intermediaries including for significant social media intermediaries to observe due diligence, and failing to observe such due diligence, they shall no longer be exempt from their liability under law for third-party information or data or communication link hosted by them.

The policies of the Government are aimed at ensuring an Open, Safe and Trusted and Accountable Internet for its users. With the expansion of the Internet and more and more Indians coming online, users are increasingly exposed to potential harm arising from improper use of cyberspace.

To help achieve the aim of ensuring an Open, Safe and Trusted and Accountable Internet, the Central Government has also made the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules”), under the Information Technology Act, 2000 (“IT Act”).

With regard to due verification of social media accounts and the terms of use for any paid services offered by them, it is informed that the due diligence requirements for a social media intermediary under the IT Rules include, in the interest of transparency, prominently publishing on its website and/or mobile app and informing users of its user agreement in English or any language specified in the Eighth Schedule to the Constitution, in the language of the user’s choice. Further, in respect of a social media intermediary which has more than 50 lakh registered users in India, such requirements also include enabling its users to voluntarily verify their accounts and provide such accounts with visible marks of verification.

With regard to steps to address the potential damage due to fake accounts, it is informed that section 66D of the IT Act penalises cheating by impersonating by means of any communication device or computer resource and the same is punishable with imprisonment of up to three years and fine of up to one lakh rupees. As the offence is a cognizable offence, State police departments take preventive and penal action as per law in respect of the same.

To help achieve the aim of ensuring an Open, Safe and Trusted and Accountable Internet by addressing the risk posed by fake accounts, the due diligence required of an intermediary under the IT Rules also includes the following:

(i) To make reasonable efforts to cause the users not to host, display, upload, modify, publish, transmit, store, update or share, among others, information which deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature, or impersonates another person;

(ii) In the event of violation of the above, to not host, store or publish, voluntarily or upon actual knowledge on receipt of a grievance or court order or notice from the appropriate government or its agency, unlawful information prohibited under law in relation to defamation, the interest of public order, decency or morality, or incitement to an offence relating to these;

(iii) To provide, upon receipt of an order from a lawfully authorised government agency, information or assistance for prevention, detection, investigation or prosecution under law; and

(iv) To have in place a grievance redressal machinery and resolve complaints of violation of the rules within 72 hours of being reported.

General public is going to harassed by this fake thing
